Tando Ngeno
Director
Tando is the Director of Ngeno & Mteto Inc. He holds a B.Proc degree, a Postgraduate Diploma in Corporate Law and an LLM (Commercial Law) degree.
He was admitted as an Attorney of the High Court of South Africa in November 1999. In August 2001 he was admitted as a Conveyancer of the High Court of South Africa and in August 2002, he was admitted as a Notary Public of the High Court of South Africa. He also has right of appearance in the High Court.
In addition to being a conveyancer, Tando has litigated on behalf of private entities and state owned entities for the past 20 years. He has undertaken litigation on civil, criminal, procurement, administrative and constitutional law in all relevant courts and various forums.
Tando has over the years litigated, and is currently in litigation for and on behalf of clients like Eskom Holdings SOC Limited, Passenger Rail Agency of South Africa, City of Tshwane Metropolitan Municipality and Lekwa Local Municipality.
Tando has extensive experience in various aspects of commercial law; such as advising & drafting various commercial policies and agreements, joint venture restructuring, the incorporation of companies, conducting due diligence investigations and transactional advisory services. He also has experience in the foreclosures of bonds on behalf of banks and perfection of bonds on behalf of state owned entities like IDC and the National Empowerment Fund.
In so far as regulatory law is concerned, Tando has been involved in a number of administrative law cases for clients such as Eskom on interruption of electricity supply to various municipalities. He has advised clients on a range of other matters, such as requests for access to information held by governmental and private bodies in terms of the Promotion of Access to Information Act. He has provided legal opinions on legal compliance on a number of areas of law. He has advised state owned entities on compliance with the PFMA, Treasury Regulations, PPFA, PAJA, PAIA etc. Tando has also been involved in the drafting of Eskom’s Supplier Suspension Policy.
Tando is an experienced labour lawyer. He has appeared at the CCMA and at the Labour court and other Bargaining Councils on behalf of the employer and employees on various labour matters. He has sat as initiator in disciplinary hearings and has also sat as Chairperson in disciplinary hearings. He has conducted training on the Basic Conditions of Employment Act and the Labour Relations Act. Tando has also drafted employment agreements and disciplinary codes for various companies.
Earl Liwalam Jafta
Director
Liwalam holds a B Juris and an LLB degree from the Universities of Transkei and Durban Westville respectively.
He started his working career in 1998 as an intern for the Parliamentary Monitoring Group (PMG) in Cape Town. Where he was involved in monitoring legislative processes in Parliament and thus gaining exposure in drafting and interpretation of laws. Liwalam was admitted as an attorney of the High Court of South Africa in 1999.
Liwalam worked for various organizations including the Legal Resources Centre, Lawyers for Human Rights, Amnesty International South Africa, the United Nations, the Road Accident Fund and Eskom Holdings (SOC) Limited.
Liwalam’s practice is mainly focused on commercial law, administrative law and litigation in the Higher Courts. He has experience in commercial contract negotiations, contract review and implementation and banking law. He frequently wrote important business contracts relating to information technology, copyrights, proprietary information, NEC (New Engineering Contract), FIDIC (International Federation of Consulting Engineers) and other forms of contracts.
Liwalam’s clients include state-owned entities such as Eskom Holdings SOC Limited. He has litigated for such entities all the way to the Supreme Court of Appeal. Some of the matters that he has litigated on have been reported in the South African Law Reports.
Liwalam has extensive experience in ICT matters, and has served as legal advisor on a number of ICT related projects. Liwalam has also provided legal advisory services on various mining, construction and energy projects.
